Terms & Conditions

These terms govern your use of CloudScale Consulting's website, WordPress plugins, and consulting services. Please read them carefully before purchasing or using any of our products.

  1. 1. Who we are

    CloudScale Consulting ("we", "us", "our") is a technology consultancy and software product business. We provide specialist consulting services in AWS architecture, cybersecurity, and platform engineering, and we develop and sell WordPress plugins for small and medium sized businesses.

  2. 2. Acceptance of terms

    Our WordPress plugins are free software under the GNU General Public License, version 2 or later. Nothing in these terms restricts the rights that licence gives you to use, study, modify and redistribute them, commercially or otherwise.

    By accessing this website or purchasing a subscription, you agree to be bound by these Terms and Conditions, our Privacy Policy, and our Refund Policy.

    If you do not agree to these terms, do not use this website or purchase any products.

  3. 3. Products and services

    CloudScale Consulting offers:

    • Free WordPress plugins: Cyber & DevTools, SEO AI Optimizer, Backup & Restore, Database Cleanup, and Site Analytics, all provided at no charge under the GNU General Public Licence, version 2 or later (GPL-2.0-or-later). Every feature of every plugin works without a subscription except Active Vulnerability Verification in Cyber & DevTools, which runs on CloudScale servers and comes with the Managed AI subscription, and CloudScale Managed Cloud Backup in Backup & Restore; the AI features accept your own API key.
    • Managed AI subscription: an optional service for Cyber & DevTools and SEO AI Optimizer, at $10/month per site, under which CloudScale Consulting supplies the AI capacity so that you do not need your own Anthropic or Google API key. This is a subscription to a service, not a licence to the plugin.
    • CloudScale Managed Cloud Backup: an optional service for Backup & Restore, at $5/month, under which CloudScale Consulting stores your site's backups off site on Amazon S3, so that you do not need your own cloud storage account. Backups are kept for 90 days. This is a subscription to a service, not a licence to the plugin.
    • Consulting services: specialist technology consulting engagements governed by separate written agreements.

    Product descriptions, pricing, and features are published on this website and may change at any time. We will notify existing subscribers of material changes with at least 30 days' notice.

  4. 4. Subscriptions and billing

    Premium plugin subscriptions are billed monthly. CloudScale Consulting is the seller of record. Payments are processed securely by PayPal, our payment provider. By purchasing a subscription:

    • You authorise us, via PayPal, to charge your payment method on a recurring monthly basis.
    • Your subscription renews automatically until cancelled.
    • You may cancel at any time via the billing portal link in your confirmation email. Cancellation takes effect at the end of the current billing period.
    • PayPal processes payments on our behalf. Your card details are entered directly into PayPal's PCI-DSS compliant checkout and are never stored by CloudScale Consulting.
    • Any applicable taxes (VAT, GST, etc.) are the responsibility of CloudScale Consulting as the seller of record and will be added where required.

    Prices are listed in USD and are exclusive of any applicable taxes unless otherwise stated.

  5. 5. Plugin licence and subscription

    All CloudScale Consulting WordPress plugins are licensed under the GNU General Public Licence, version 2 or later (GPL-2.0-or-later). You may use, study, modify, and redistribute them in accordance with that licence, on as many sites as you like, whether or not you hold a subscription.

    Upon payment of the Managed AI subscription fee, we additionally grant you, for the duration of your active subscription:

    • Use of the CloudScale Managed AI service from one (1) WordPress site per active subscription, identified by a per-site licence key.
    • Access to CloudScale Active Vulnerability Verification for a site you own.
    • Priority email support from CloudScale Consulting.

    Upon payment of the Managed Cloud Backup subscription fee, we grant you, for the duration of your active subscription, use of CloudScale Managed Cloud Backup storage for the sites using your licence key. You remain responsible for the content of your backups and for keeping any backup encryption password you set: it is never sent to us and cannot be recovered.

    The subscription is for the service, not the software: it may not be shared between sites or resold, and cancelling it removes access to the service while leaving the plugin fully usable with your own API keys. Use on staging or development environments that mirror a subscribed production site is permitted.

  6. 6. AI API usage

    The Cyber & DevTools and SEO AI Optimizer plugins include artificial intelligence features powered by Anthropic Claude, Google Gemini and, for image generation, OpenAI. You may use these features in either of two ways:

    • Your own API key. The plugin sends requests directly from your server to the provider under your account. AI API costs are then billed by the provider to you, are not included in any CloudScale fee, and are solely your responsibility. CloudScale Consulting does not receive, access, process, or store your API keys or the content of those requests; they remain on your WordPress installation.
    • The Managed AI subscription. The plugin sends the same request data to api.cloudscale.consulting, and CloudScale Consulting forwards it to the AI provider under its own account and returns the reply. The data sent is described in each plugin's readme under "External services" and in our Privacy Policy. Usage is subject to a fair-use allowance published on this website.

    Use of third party AI APIs, directly or through the Managed AI service, is subject to the respective providers' terms of service and acceptable use policies.

  7. 7. Acceptable use

    You agree not to use any CloudScale Consulting product or service to:

    • Violate any applicable law or regulation.
    • Infringe the intellectual property rights of any third party.
    • Attempt to gain unauthorised access to systems or networks.
    • Distribute malware, spam, or other harmful content.
    • Reverse engineer, resell or redistribute access to our hosted services (the api.cloudscale.consulting API, Managed AI, Managed Cloud Backup and Active Vulnerability Verification) without permission. This does not apply to the plugins themselves, which the GPL lets you modify and redistribute.

    We reserve the right to suspend or terminate access to any product without notice if we determine that a user is in material breach of these terms.

  8. 8. Intellectual property

    All content on this website, including text, graphics and logos, is the property of CloudScale Consulting or its licensors and is protected by applicable intellectual property laws.

    The source code of every CloudScale Consulting WordPress plugin is licensed under GPL-2.0-or-later and is published on WordPress.org and GitHub; the copyright remains with CloudScale Consulting and the licence terms of the GPL govern its use. The CloudScale hosted services (api.cloudscale.consulting, the Managed AI service, Managed Cloud Backup and Active Vulnerability Verification) are operated by CloudScale Consulting and are not part of the plugin code. The CloudScale Consulting name, logo, and brand are not licenced for third party use without prior written consent.

  9. 9. Disclaimer of warranties

    All products and services are provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non infringement.

    We do not warrant that the plugins will be uninterrupted, error free, or free of viruses or other harmful components. You are responsible for testing plugins in your environment before deploying to production.

  10. 10. Limitation of liability

    To the maximum extent permitted by applicable law, CloudScale Consulting shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of any product or service, including but not limited to:

    • Loss of data, revenue, or profits.
    • Website downtime or security incidents.
    • Costs incurred via third party AI API usage.

    Our total liability to you for any claims arising under these terms shall not exceed the total subscription fees paid by you in the 12 months preceding the claim.

  11. 11. Governing law

    These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

    For customers in other jurisdictions, nothing in these terms limits your statutory consumer rights under your local law.

  12. 12. Changes to these terms

    We may update these Terms and Conditions from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify active subscribers by email at least 30 days before the change takes effect.

    Continued use of any product or service after the effective date of changes constitutes acceptance of the revised terms.
